touchpad problem

Hi
I've been a lurker here for a good few months now and finally was able to get a miniplayer just over a week ago.
In short, I love the player, but I am having a major problem with the touchpad. When I have just turned the player on, the touch pad works perfectly but if I use the player constantly for a length of time, the touch pad just stops working properly. I cannot scroll or use it for any useful purpose and the only way to clear this seems to be to turn the miniplayer off for a while and let it "cool down" as it were. The clicky buttons continue to work fine.
I have tried using the touchpad calibration, but either I'm not using it correctly or it does nothing or at all, and I still have to resort to turning it off and leaving it alone. If I turn it off and on again in quick succession the problem does not go away, I actually have to leave it for a while. The problem shows up after playing about 30 minutes of video and after about the same length of time (maybe a little longer) of playing audio.
Has anyone else encountered a similar problem? I can't really determine for sure if it is a hardware or software problem. I had the thought that it might be an overheating problem which could affect the touchpad functionality.
I bought from houseofdap.com and presumably they will honour any warranty but I don't relish the idea of returning it, particularly at this time of year, so any ideas, help or advice would be greatly appreciated.

doesnt matter, sometimes problems are related to firmawares loaded incorrectly.
Try loading firmware, be aware about Miniplayer's version, TP or SP

Further, I had to recharge the battery for the first time last night, which I did using the external battery pack. The problem is, after this the touchpad is now completely unusable, so I think I'm looking at a warranty returns situation
